Terms and conditions of the programme


These General Terms and Conditions (hereinafter “GTC” or "GTCs") regulate the access and use of the Barceló Pro Rewards programme, which is property of Barceló Gestión Hotelera, S.L.

 

Identification of the parties

1. On the one hand, Barceló Gestión Hotelera, S.L. (hereafter "Barceló"), with registered office at C/ Rover Motta 27, 07006, Palma de Mallorca.

And, on the other hand, the natural person (hereinafter, the "Member"), who is registered as a participant of the Barceló Pro Rewards program (hereinafter, the "Program" or "Barceló Pro Rewards").

 

2. The Registrant declares to be of legal age (i.e. over 18 years of age) and to have the legal capacity to register with Barceló Pro Rewards in accordance with the present GTC, which he/she fully understands and comprehends. If the services are contracted by a minor, Barceló shall not be liable in any case and the minor, his/her parents, or guardians must assume the expenses incurred.

 

3. The benefits of the Program are not cumulative with the benefits of any other card or program of the participating companies. The Member has the right to choose the company from which he/she wishes to receive his/her benefits.

As an example, if a Member has booked on Barcelo.com (customer booking website) or directly with the hotel and has obtained my Barceló loyalty program benefits or other benefits provided by the hotel on those bookings, he/she will not be able to import those bookings into Barceló Pro Rewards.

 

Members - Clients

4. Program members are individuals, professionals and/or retail travel agents (excluding online travel agencies) who are registered with Barceló Pro Rewards. The Program will provide an individual user code and password for participation. Each code must be associated with a professional or agent, and a company or travel agency. In the case of large networks with an agreement with Barceló Hotel Group, it is also possible to register offices where members share a single user code and password to participate in the Program, subject to prior agreement with Barceló Pro Rewards.

 

5. The Program may terminate registered Members who have not performed any activity to earn points for imported reservations within one (1) year.

 

6. The accumulation of points by a Member is related to his/her work in the travel agency or company in which he/she is employed at the time of registration in the Program. In this sense, if such Member leaves the agency or company where he/she worked when he/she joined the program, he/she must redeem the points he/she has accumulated up to the moment of leaving the company, with the prior written authorization of the agency or company. If the director of the aforementioned agency or company denies the authorization, the points will be cancelled. If travel agents or professionals of the same travel agency or company change offices, they can request the transfer of their points to a new account associated with the new branch.

The Member will be responsible for checking that the contact details provided on www.barceloprorewards.com are correct and up to date. If it is not possible to award points due to an error in the information provided or updated by the Member, Barceló reserves the right to cancel the corresponding points.

 

7. As the company that owns the Program, Barceló reserves the right to withdraw the participation code, cancel the points in the account and enforce the corresponding liabilities against any Barceló Pro Rewards Holder who makes improper or fraudulent use of the Program, or does not comply with the rules and procedures contained in the GTC.

 

Purpose of the program and points accrual

8. The purpose of the Program is to carry out a promotion in which Barceló Pro Rewards Members can accumulate points redeemable for stays at participating hotels or for gifts from the catalog.

 

9. Members may accumulate points through the following methods:

a) Register at www.barceloprorewards.com  :Members will recieve 100 points for registering for Barceló Pro Rewards.

b) Importing bookings onto www.barceloprorewards.com:Members will receive points, based on the application of the program's GTCs, for each room night or event booked at any participating hotel from the time they register as a Member. Members may also import any room night or event reservations at any participating hotel made up to three (3) months after the check-in date, provided the registration date is after the Member's check-in date. The points will be added to the Member's account once the imported reservations have been validated by the hotel.

Example:

A Member that registers in the program on 1 January and wants to access the client area on 1 July to import the following reservations needs to review the following:

1) Reservation with an entry date of 1 May: this reservation can be imported because the entry date of the booking is within three (3) months prior to the import date.

2) Reservation with an entry date of 1 September: this reservation can be imported without problems because the entry date has not yet passed.

3) Reservation with an entry date of 1 March: this reservation cannot be imported because the entry date is more than three (3) months prior to the date of import of the reservation.

In all cases, the date of entry of the reservation must be after the Member's registration date in the program.

When importing bookings into the program, the Partner must truthfully indicate the correct booking channels in the corresponding form to be checked and verified. Otherwise, Barceló reserves the right to deny these imported bookings at any time, and in the event that the Member has already earned points for these bookings, these may be denied or reclaimed by applying point 7 of the GTC.

 

c) Through Barceló Pro - Automatic import of bookings at www.barceloprorewards.com. By booking through www.barcelopro.com the Member must indicate his or her Barceló Pro Rewards Member code in the corresponding section so that the reservation is automatically credited to his or her professional rewards account (Barceló Pro Rewards). All bookings made via www.barcelopro.comwill receive 5 extra points per Room Night. The points will be added to the Member's account once the imported reservations have been validated by the hotel.

d) Each time the Member completes one of the e-learning courses included in Barceló Pro Rewards, he/she will obtain 20 points. Each course can be taken as many times as the Member wishes, but he/she will only receive the corresponding points the first time he/she answers the questions correctly.

 

10. The Member may periodically receive promotions that will multiply the number of points earned. These promotions are not cumulative. The one with the highest points will automatically be applied.

 

11. Points earned through Barceló Pro Rewards do not expire, as long as the Member has registered a reservation during the previous year. If more than one (1) year elapses without the Member making a reservation, Barceló may cancel all of the Member's available points or delete the Member's account, as set forth in point 5 of the GTC.

 

12. The Member will only be able to claim points for imported reservations that the hotel has denied by sending a copy of the original voucher or invoice to the e-mail: info@barceloprorewards.com within a maximum period of three (3) months after the hotel denies the reservation; after this period the Member will not be able to claim points.

 

13. All points earned by the Member in Barceló's previous loyalty programs (Barceló Partner Club and Barceló BC) were transferred to Barceló Pro Rewards. These points are subject to the terms and conditions set forth in these GTCs.

 

Barceló Pro Rewards Member Category

14. Barceló Pro Rewards Members will belong to one of the following levels: LOYAL, SILVER, GOLD and PLATINUM, depending on the points earned exclusively from approved bookings and the number of e-learning courses completed.

15. To stay in a level, programme Members must accumulate a certain amount of points equal or superior to the amount necessary to reach that level during the following 365 days after the last level increase. If this number of points is not reached within the established period, the Member will be downgraded to the level he/she has reached according to the points obtained during that period.

Example:

A user reaches GOLD level on 1st February in year X:

1) If on February 1 of year X+1 the Member has earned 10,000 points or more, he/she will remain at the GOLD level.

2) If on February 1 of year X+1 the Member has obtained between 4,000 and 9,999 points, he/she will be downgraded to SILVER level.

3) If on February 1st of year X+1 the Member has obtained less than 4,000 points, he/she will be downgraded to LOYAL level.

 

16. E-learning courses considered for upgrading will only count the first time each of the courses available in the Program is completed.

 

Use of points

17. Points accumulated on www.barceloprorewards.com can be redeemed exclusively through www.barceloprorewards.com  for stays at participating Barceló Hotel Group hotels or for any product in the gift catalogue, as long as the contact information provided at www.barceloprorewards.com  is correct and up to date, and unless otherwise agreed with the participating travel agency or company. Points have no cash value, nor are they redeemable for cash, services or other goods other than those specified above. The benefits offered in the catalogue can be periodically reviewed and modified by the companies participating in the programme, without the need to provide prior notice to the Members.

 

Points can only be redeemed once the Member has a minimum of 1000 points earned for validated bookings. They cannot be redeemed if the Member only has: welcome points, points obtained for courses taken, or other concepts not related to points obtained for validated reservations.

 

 

18. Stays booked at participating Barceló Hotel Group hotels through points will be on a double room basis, on a bed and breakfast or all-inclusive basis, when offered by the hotel. These stays may only be enjoyed by the Member, who may be accompanied by one (1) adult and, subject to hotel availability, up to two (2) children per room (ages 0 to 11) or one additional adult. The stay will be confirmed according to the availability of the requested hotel.

The following are the points required to redeem hotel rooms, depending on the brand of the participating Barceló Hotel Group hotel where the Member wishes to make the reservation: Consult the points redemption table.

 

The penalty for cancellation or no-show of reservations confirmed with points will be:

- Penalty of 50% of total points: if you cancel from the 3rd day up to one (1) day before the check-in date.

- Penalty of 100% of total points: if you cancel the day of check-in, if you have a no-show, or cancel days of stay after check-in.

 

To modify a reservation, the Member must cancel the original reservation and any cancellation penalties indicated in the previous point will be applied. You will then be able to make a new reservation request.

 

19. To redeem points for stays, it is essential to have the total number of points required. Members can combine points and cash when redeeming stays. If the Member chooses the latter option and has received confirmation of the availability of the room(s), the value of the points corresponding to the stay selected at the time of the reservation request will be deducted from the Member's account, and the Member will be charged directly at the hotel for the amount indicated in the reservation, plus local taxes if any.

 

20. All reservations made with redeemed points will be made through www.barceloprorewards.com, at least five (5) days prior to the date of entry. Once the reservation is requested, the points will be deducted from the Member's account.

 

21. Items from the gift catalogue will only be delivered within Spain. Members not residing in Spain may redeem their points for stays at any participating hotel or for any of the gift cards (e-cards) published in the Program.

 

Once points have been redeemed for an item, it is not possible to cancel that redemption or return the points from that redemption.

 

22. Depending on the availability of stock in the gift catalogue, the program reserves the right to substitute the redeemed gifts for others of equal or higher level upon prior notice to the Member.

 

Transfer of points between Members

23. Barceló Pro Rewards Members with more than 1,000 points from approved bookings may request to transfer their points to another Member working in the same company, with a maximum of three (3) requests per year.

Points awarded by the Program (e.g., 100 points earned upon registration) are not transferable.

 

24. Barceló does not allow, and therefore prohibits, the sale of program points between Members. Barceló reserves the right to cancel the points it considers sold or transferred in violation of the GTC.

 

Additional Information for Barceló Pro Rewards Members

25. The same person may only register in the Program as a Member once.

 

Partners who provide false or inaccurate data, or who, in general, do not comply with the present GTC, shall be removed from the Program. Regardless of such removal, Barceló reserves the right to take any legal action it deems appropriate against violators of this Program.

 

27. Barceló reserves the right to terminate the membership of any Member who misuses the promotion, participates in fraudulent acts or harms other Members, or establishes speculative or commercial schemes. If BARCELÓ or any entity professionally related to this promotion detects any anomaly or suspects that a Member is hindering the normal development of the Promotion by improperly altering the entries through any technical or computer procedure, or is performing any fraudulent activity that is compromising the transparency of the Promotion, Barceló reserves the right to eliminate or even withdraw the incentive automatically and without explanation to any Member who has benefited directly or indirectly from this type of fraudulent activity.

Thus, Barceló declares that it has enabled the appropriate mechanisms and technological supports to detect any possible fraudulent, anomalous or intentional act that intends to alter the normal participation in the Program, such as the registration in the Program of the same person through several profiles.

 

28. Barceló reserves the right to take legal action against any person who performs any act that could be considered manipulation or falsification of the Program.

 

29. Barceló will not be held liable for damages of any kind that may arise from the temporary lack of availability or continuity of the operation of the Programme's services.

 

30. Channels: the Program reserves the right to vary, without prior notice, the booking channels through which points may be earned.

 

31. Each month, the Program may issue a statement of the operations carried out and the points earned or used. If the declaration is incorrect, the Barceló Pro Rewards Holder will inform Barceló by providing the required documentation, which is indicated in point 12.

 

The Program is not responsible for rejected, lost, or misdirected e-mails, or for typographical or printing errors in any communication from the Program, or any consequence thereof.

 

32. If any of the companies participating in the Program improperly refuses to award points and other benefits to a Member, the Program's responsibility shall be limited to correcting the error by awarding the points owed, as soon as the Member provides evidence of his or her rights. Neither Barceló nor the Program shall be held responsible for the actions or omissions of the companies participating in the Program, both in the provision of the services and in everything related to their participation in the Program, except for the correction of errors referred to in this point.

 

33. Barceló and the rest of the companies participating in the Program reserve the right to modify the applicable points tables, the present GTC, or any aspect related to the Program or the participation of the Members in the Program, at any time and without the need to provide prior notice to the Members.

 

34. Registered Members may terminate their participation in the Program at any time by notifying Barceló by e-mail at: dpo@barcelo.com.

 

35. Barceló Pro Rewards may also be cancelled at any time the owner company, Barceló, deems it appropriate, giving registered Members a maximum period of three (3) months to redeem their points. In the event of cancellation of the program, and​​ once the pre-announced deadline has passed, the points accumulated by the Members will be automatically cancelled. Barceló shall in no event be liable for any loss, damage, or injury that the Member may suffer in the event of such cancellation.

Copyright, trademarks, software

37. All Programme content, including content, brands, graphics, logos, icons, buttons, images, and software, are the property of Barceló or its content providers and are protected by Spanish and international industrial and intellectual property regulations. 

 

The selection, compilation, ordering, programming, design, and placement of all content on the website is the exclusive property of Barceló and is protected by Spanish and international industrial and intellectual property regulations.All software used on the website is the property of Barceló or its software suppliers and is protected by Spanish and international intellectual and industrial property laws.

 

Any other use of the content or photographs from the website is strictly prohibited, including the reproduction, modification, distribution, transmission, subsequent publication, full or partial display, or representation thereof without express consent from Barceló or its suppliers.

 

General information, laws and jurisdiction

38. In accordance with Spanish tax legislation, prizes awarded for participation in games, contests, sweepstakes or alternative combinations related to the sale or promotion of goods or services are subject to withholding or payment on account when the value of the prize exceeds €300. The prize of this promotion will be subject to the tax legislation applicable at all times and its development provisions. Therefore, in compliance with the provisions of the same, the body responsible for the management of the program will make the corresponding payment on account of the prize awarded. This account payment will not be passed on to the winner as a necessary condition for the enjoyment of the prize, which will be paid in advance to the agency as a cash value. The agency may request accreditation of the winner's tax domicile, applying the current percentage that corresponds to the payment of the value of the prize. In any case, it is the winner's responsibility to comply with all tax obligations applicable to the prize received, according to the information contained in the declaration of deductions and payments of the IRPF that will be provided by the body in charge of managing the program.

The rest of the gifts obtained through the redemption of points in the program do not require this withholding or payment on account as the gift does not constitute any of the income provided for in article 75 of Royal Decree 439/2007, of March 30, which approves the Income Tax Regulation Law. Notwithstanding the foregoing, in accordance with Articles 33 and 43 of the Personal Income Tax Law 35/2006, of November 28, 2006, it is the partner's responsibility to declare the corresponding capital gain derived from the donation in his/her personal income tax return, at market value. If you wish to obtain a certificate for Personal Income Tax purposes, you can request it by sending an e-mail to the following address: info@barceloprorewards.com

 

39. If any clause included in the GTC is declared totally or partially null or void, the remaining conditions of such provision or part thereof shall remain in force and shall be deemed excluded.

 

40. Barceló Pro Rewards TCGs are governed by the legal regulations in force in Spain. For any doubts that may arise regarding the interpretation and application of the GTC, the parties expressly submit to the jurisdiction of the courts and tribunals of Palma de Mallorca, waiving their own jurisdiction.
